Introduction
These terms (our "Terms") constitute a legal agreement between you and Mom’s Time ("we", "us", or "our"). When you use our website, app, or services, you agree to these Terms and any policies linked herein. Moms Time Sdn Bhd is a private limited company registered under SSM Malaysia (Company No. 202401055563). If you do not agree to these Terms, please do not create an account, make a booking, or purchase a voucher through Mom’s Time.
1. User Accounts and Personal Data
To provide our Services, we must collect and use your personal data. Before booking or purchasing through us, please read our Privacy Policy.
Account Accuracy: You must provide accurate and complete information when creating an account. Failure to do so may result in the rejection or cancellation of your booking.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at admin@momstime.my or via online chat if you suspect unauthorized use.
Eligible Use: You confirm you are at least 18 years old and have the legal capacity to agree to these Terms. Our online services are for individuals only. For corporate bookings or purchases, please contact us at momstime.my@gmail.com or via WhatsApp.
2. Defined Terms
Independent Professionals: Self-employed professionals who provide services you book through Mom’s Time.
Third-Party Partners:Independent businesses that provide services through the Mom’s Time platform.
Third-Party Partner Professionals: Individuals engaged by Third-Party Partners to deliver services.
3. Scope of Services
Mom’s Time provides a booking and purchase platform. Through our site and app, you can:
- Book services carried out by Independent Professionals ("Professional Services").
- Book services carried out by Third-Party Partner Professionals ("Third-Party Partner Services").
- Buy vouchers to use for bookings.
Mom’s Time acts strictly as an introducer and commercial agent for Independent Professionals, Third-Party Partners, and retailers. We handle bookings, accept orders, and collect payments on their behalf. We do not provide the actual professional services, third-party partner services, or products ourselves. The legal contract for services or products is strictly between you and the respective Independent Professional, Third-Party Partner, or retailer, who is solely responsible for delivery and service quality.
While we verify provider identities, perform criminal background checks, and enforce strict hygiene measures to ensure they meet Mom’s Time standards, we do not guarantee their reliability, quality, or suitability. Users must exercise sound judgment regarding personal safety and property.
4. Educational and Medical Disclaimer
All educational content within the Mom’s Time platform is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Mom’s Time is not a healthcare provider. References to “treatment” or “therapy” do not mean medical treatment.
*Important Note on Engorgement Services: Breast engorgement can be a complex condition. Consumers acknowledge that a single session may not fully alleviate symptoms, and more than one service, a multi-session treatment plan, or a combination of specialized clinical/lactation services may be required to completely solve the engorgement. If you have a medical concern, always seek the advice of a qualified healthcare professional.
5. Booking and Payment Process
Payment: All treatment fees and product fees are payable through our site, app, or by phone at checkout. Full payment is due at the time of booking.
Discharge of Debt: We collect fees as the commercial agent for providers. Once we receive your full payment, your debt to the Independent Professional or Third-Party Partner is discharged.
Security: We use encrypted, secure payment mechanisms. Unless we are negligent, we are not liable for unauthorized third-party access to your information. Card payments must be authorized by your issuer.
Customer Responsibilities: By making a booking, you are responsible for providing accurate billing details, ensuring the professional has access to your designated premises with a suitable space and appropriate facilities (including adequate lighting), and ensuring the professional’s health and safety while at your premises.
Vouchers and Credits
Expiry: Mom’s Time vouchers and credits expire 12 months from the date of issue unless a specific promotional expiry date is stated in writing.
Refunds: Vouchers and credits are non-refundable and cannot be exchanged for cash. Digital vouchers are delivered via email immediately upon payment confirmation.
Cancellation of Vouchers: If you purchase a digital or physical voucher online, you have 14 days from the day after purchase to cancel and receive a full refund, provided the voucher has not been redeemed. Contact momstime.my@gmail.com to cancel.
Complimentary Vouchers: Vouchers issued free of charge may be voided by us in part or in full at any time, for any reason, without notice.
7. Prices and Fees
All fees include platform fee where applicable. Treatment prices vary and may change over time. The price you pay is the price in force at the time of booking. Subsequent price changes will not affect bookings that have already been confirmed.
8. Cancellations and Refunds Policy
You do not have a statutory right to cancel bookings for Professional Services or Third-Party Partner Services, but you hold the following contractual rights:
Cancellation 24 hours or more before the appointment: No charge.
Booking within 24 hours of the appointment: Free cancellation within a 10-minute "grace period" after booking confirmation.
Late Cancellation (within 24 hours of appointment or after the grace period): We may retain or charge 30% of the treatment fee.
Very Late Cancellation (within 2 hours of the appointment): The provider may retain or charge 100% of the treatment fee.
You will be charged the full treatment fee (100%) if you:
- Attempt to cancel on or after the scheduled appointment time.
- Fail to attend the appointment or fail to grant entry at the designated premises.
- Provide inaccurate address, personal, or contact details.
- Book a treatment that cannot be performed because you meet a contraindication listed on the treatment description page.
Cancellation fees compensate professionals for slots that cannot reasonably be refilled on short notice. Mom’s Time may, at its sole discretion as an agent, waive these fees for genuine reasons outside your control.
9. Extensions and Delays
If you wish to extend your booked session, the professional will accommodate if available, and extra time will be charged in advance at standard treatment rates.
If you are more than 10 minutes late starting at your premises, the professional may end the service at the originally agreed time without a reduction in price. Alternatively, if the professional agrees to perform the full-duration service past the scheduled window, you must pay for the extra time in advance.
10. Promo Codes and Referrals
Promotional and referral codes have no cash value, are valid only for the stated period, and are limited to one per person.
Codes are for personal, non-commercial use and must not be duplicated, sold, or published on discount forums/coupon websites.
Referral codes are capped at 25 referrals per user. To request a limit extension, email momstime.my@gmail.com. We reserve the right to modify or terminate promotional offers at any time due to misuse.
11. Code of Conduct and Zero-Tolerance Policy
All Mom’s Time treatments are strictly professional, therapeutic, and non-sexual. We maintain a zero-tolerance approach to inappropriate behavior, including illicit or sexually suggestive remarks, sexual advances, drug use, or excessive drinking. Suggestive behavior constitutes sexual harassment. We report, ban, and permanently deactivate the accounts of offenders.
Client Expectations:
- Environment: Ensure your home feels clean, safe, and comfortable for the professional.
- Hygiene: Take a quick shower before a massage, or wash your hands before nail treatments.
- Boundaries: Wear underwear on your lower half at all times. Never make sexual comments, requests, or gestures, even as a joke. Do not touch or stare inappropriately at your professional.
- Respect: Avoid personal questions, political discussions, or violations of cultural and religious boundaries. Use in-app chat to share practical details (e.g., pets, parking, or illnesses) ahead of time.
- Privacy: All communication must stay within the *Mom’s Time* app to keep your phone number private. Always ask for consent before taking photos.
No Session Splitting: Each session is strictly for one individual; treatment time cannot be split among multiple people.
12. Prohibited Platform Use
You must use our Services only for lawful booking and purchasing purposes. You are prohibited from:
- Restricting or inhibiting others from using the Services.
- Infringing upon privacy, intellectual property, or civil rights.
- Harassing, abusing, or threatening professionals or staff.
- Harvesting data or collecting user information without consent.
* Using automated tools, malware, or viruses to disrupt or gain unauthorized access to our network, servers, and systems.
13. Intellectual Property
Mom’s Time, our logos, brand assets, graphics, and all related intellectual property belong exclusively to us or our licensors. These terms do not grant you any ownership or rights to our platform content. All rights are reserved.
14. Limitation of Liability and Indemnity
As-Is Basis: Use of our site, app, and Services is on an “as is” and “as available” basis. We do not guarantee uninterrupted, error-free, or virus-free access.
Limitation: To the maximum extent permitted by law, Mom’s Time is not liable for direct, indirect, punitive, incidental, or consequential damages—including loss of use, data, revenue, profits, or goodwill—arising from your use or inability to use our platform.
Statutory Rights: Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or matters where limitation is unlawful.
Indemnity: You agree to defend, indemnify, and hold harmless Mom’s Time against any claims, losses, damages, fines, penalties, and legal fees arising from your misuse of the Services or breach of these Terms.
15. Severability, Changes, and Termination
We may update these Terms or suspend features of the Services at any time. Updates will be effective immediately once posted with a revised “Last Updated” date. If you do not agree to the changes, you must stop using the Services. If any part of these Terms is found invalid by a court, the remaining provisions will continue in full force.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia. You agree that the courts of Malaysia shall have exclusive jurisdiction over any claim or dispute arising under these Terms.
